Terms of Service

These Terms of Service ("Terms") govern your access to and use of the LoungeChat mobile application and related services (the "Service") provided by LoungeChat ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By creating an account or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not access or use the Service. We reserve the right to modify these Terms at any time. Continued use after changes constitutes acceptance.

To the maximum extent permitted by applicable law, LoungeChat, its owners, officers, employees, affiliates, and agents shall not be liable for any damages, losses, injuries, claims, or costs — whether direct, indirect, incidental, consequential, or otherwise — arising from or related to your use of the Service, interactions with other users, content posted by any party, or any other aspect of the Service. You acknowledge that you use LoungeChat at your own risk.

2. Eligibility

You must be at least 17 years of age to use LoungeChat. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms. We reserve the right to request proof of age and to terminate accounts that do not meet eligibility requirements.

3. Account Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to provide accurate, current, and complete information during registration and to update such information as necessary. You must notify us immediately of any unauthorized access to your account.

4. User Content License

By posting, uploading, or sharing content on LoungeChat, you grant us a worldwide, perpetual, irrevocable, non-exclusive, royalty-free, sublicensable, and transferable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such content in any form, media, or technology now known or later developed.

This license continues even if you stop using the Service or delete your account. You represent that you own or have the necessary rights to all content you submit and that your content does not violate any third-party rights.

5. Prohibited Content & Conduct

You agree not to post, share, or engage in any of the following:

•Sexually explicit or pornographic material, including nudity

•Sexual solicitation or sex trafficking

•Content depicting or promoting the sexual exploitation of minors (CSAM)

•Realistic depictions of extreme violence or gore

•Threats of violence or incitement to violence

•Harassment, bullying, or intimidation of other users

•Hate speech, slurs, or content targeting individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or national origin

•Terrorism or recruitment for violent extremist organizations

•Promotion or sale of illegal drugs, controlled substances, or drug paraphernalia

•Sale, promotion, or facilitation of firearms, ammunition, or explosives

•Doxxing — sharing another person's private information without consent

•Impersonation of individuals, brands, or organizations

•Fraud, scams, phishing, or deceptive schemes

•Spam, unsolicited advertising, or commercial solicitation

•Malware, viruses, or attempts to compromise system security

•Content that promotes self-harm or suicide

•Intellectual property infringement (copyrighted material, trademarks)

•Misleading or deliberately false information intended to cause harm

•Any content illegal under applicable local, state, or federal law

We reserve the right to investigate and take appropriate action against anyone who violates these rules, including removing content, suspending or terminating accounts, and reporting to law enforcement.

6. Automated Video Call Moderation

By using video call features on LoungeChat, you acknowledge and consent to real-time automated monitoring of your video feed. Video call frames are periodically captured and analyzed by AI-based content moderation systems to detect prohibited content.

Our automated moderation systems may take the following actions without prior human review:

•Immediately terminate a video call if prohibited content is detected

•Store flagged video frames and associated metadata for moderator review

•Issue warnings, reduce your reputation score, or suspend your account

•Report suspected illegal content (including CSAM) to law enforcement authorities

You may request human review of any automated moderation action by contacting our support team. If you do not consent, you should not use the video call features of the Service.

7. Virtual Currency (Coins)

LoungeChat may offer virtual currency ("Coins") that can be purchased or earned within the Service. Coins have no real-world monetary value and cannot be exchanged for cash. Coins are non-refundable and non-transferable. We reserve the right to modify, manage, regulate, or eliminate Coins at any time without liability to you.

8. Purchases & Premium

Premium features and in-app purchases are processed through your app store provider (Apple App Store). All purchases are final and non-refundable except as required by applicable law. Subscription renewals are automatic unless cancelled before the renewal date. Pricing may change at any time.

9. Termination

We reserve the right to suspend or terminate your account at any time, for any reason, with or without notice, at our sole discretion.

You may delete your account at any time through the app settings. Upon termination, your right to use the Service immediately ceases.

When you delete your account:

•Your profile and all personal information are permanently removed

•Your chat messages are anonymized and disassociated from your identity

•Your uploaded files (photos, media) are permanently deleted from our storage

•Your authentication credentials are revoked, including Apple Sign In tokens

If your account has unresolved moderation issues at the time of deletion, we will retain a limited legal hold record for up to one year.

10. Data Retention After Termination

Upon account deletion or termination, we may retain your data, content, and associated information for as long as legally permissible.

Retained data may be used for legal compliance, dispute resolution, fraud prevention, and enforcing our agreements. Specifically:

•Legal hold records for accounts with moderation issues (up to 1 year)

•Hashed email addresses for fraud prevention and repeat-offender detection

•Identity verification session IDs (actual documents are held by our verification partner)

•Anonymized and aggregated data derived from your usage (retained indefinitely)

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT.

We do not endorse, verify, or guarantee the accuracy of content posted by users. We are not responsible for the conduct of any user on or off the Service. You use the Service at your own risk.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, LOUNGECHAT AND ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR ANY DAMAGES, LOSSES, INJURIES, CLAIMS, OR COSTS OF ANY KIND WHATSOEVER ARISING FROM OR RELATED TO YOUR USE OF OR INABILITY TO USE THE SERVICE.

IN NO EVENT SHALL LOUNGECHAT'S TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU HAVE PAID TO LOUNGECHAT IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR ONE HUNDRED DOLLARS ($100), WHICHEVER IS LESS.

13. Indemnification

You agree to indemnify, defend, and hold harmless LoungeChat and its officers, directors, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses arising out of or in any way connected with your access to or use of the Service, your content, your violation of these Terms, or your violation of any third-party rights.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict-of-law provisions. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Delaware.
